The implementation of new H-1B visa rules has introduced a significant shift in the selection process, with a weighted lottery system now favoring higher-wage applicants. This change is intended to address concerns over foreign workers displacing American jobs and the perceived indentured status of visa holders. As a result, 68% of Level III and 64% of Level IV workers were selected in the latest cycle, compared to only 40% and 36% for Level I and Level II workers, respectively.
The weighted lottery provides applicants earning higher salaries with four times better odds than their lower-wage counterparts, while employers are now required to pay a $100,000 fee for each new application. This fee has become a barrier for many rural healthcare facilities and startups looking to hire international talent, impacting their ability to recruit necessary professionals.
Despite these challenges, experts like Xiao Wang, co-founder and CEO of Boundless Immigration, believe the changes are functioning as intended. However, Priyanka Kulkarni, CEO of Casium, noted that this cycle has seen a decrease in registrations compared to the previous year, indicating a shift in the dynamics of the H-1B application process.
