In a significant ruling, United States District Judge Mark Pittman has upheld the inclusion of Elon Musk's emails from Tesla and SpaceX in the ongoing lawsuit against Apple and OpenAI. The lawsuit, initiated by Musk, alleges that Apple's App Store rankings for Grok were manipulated through collusion with OpenAI, which partners with Apple to integrate ChatGPT into its services.
Previously, Judge Hal R. Ray, Jr. had agreed to involve Craig Federighi as a custodian and compelled Apple to disclose documents related to its collaboration with Google for the new Siri. Despite X and xAI's arguments that the emails were not under their control, Judge Ray determined that Musk's roles across these companies justified their discoverability.
Following this decision, X and xAI filed an objection and requested a stay on the order. However, Judge Pittman rejected their motions, affirming Judge Ray's findings and emphasizing that there was sufficient reason to believe Musk uses these accounts for business purposes across his various enterprises.
