Elon Musk has made amendments to his lawsuit against OpenAI, indicating that he does not intend to claim any of the $150 billion in damages personally. Instead, he wishes for any potential damages awarded to benefit the nonprofit arm of OpenAI. If successful in court, Musk also seeks to have CEO Sam Altman removed from the board of the nonprofit organization.
The lawsuit, initiated in 2024, alleges that OpenAI transformed into a "closed-source de facto subsidiary" of Microsoft following its shift from a nonprofit to a for-profit model. Musk contends that this change misled him as a donor and claims a right to a share of the company’s valuation as a co-chair of its founding group.
As the trial approaches, tensions between Musk and Altman may escalate, given both parties’ history of engaging in controversial public relations efforts.
