The suit, which seeks class-action status, claims that the actual usage caps for the Max 5x and Max 20x tiers are significantly lower than what is advertised by the company.
Kahn, who upgraded to the Max 20x plan in April 2026, reported quickly reaching his weekly usage limits, stating that a single five-hour session consumed 15 percent of his allowance. The Max plans, priced at $100 and $200 per month, are marketed as offering up to five and twenty times the usage of the Claude Pro plan, which costs $17 per month.
The lawsuit highlights concerns over the clarity of usage limits and the variability based on different factors such as message length and features used. Anthropic has not commented on the ongoing legal situation, which has sparked debate among users on platforms like Reddit regarding the platform's rate limits.
