This ruling follows a lawsuit filed by iyO, which accused OpenAI of trademark infringement after the announcement of their collaboration last year to create AI-driven products.
Judge Trina Thompson expressed skepticism about OpenAI's intentions to abandon the io branding, citing potential future use of the mark as a concern. She noted that iyO is likely to prevail in its trademark claim and warned of ongoing irreparable harm to iyO's business, including the risk of losing investors and brand value. The court acknowledged the results of a consumer survey submitted by iyO, which suggested that the two brands could cause confusion among consumers.
As the injunction takes effect, the case will proceed into the discovery phase, following a separate ruling by Judge Peter H. Kang that mandated a meeting between legal representatives from both companies.
